Travel Moola: Terms and Conditions
- Introduction and Interpretation
1.1 These Terms and Conditions and any special conditions in writing by Sandra (Sandy) Müller and Shane Muller (Directors of Gypsy Life (Pty) LTD) trading as Travel Moola (hereinafter referred to as “Travel Moola”) constitute the entire Terms and Conditions between Travel Moola and any person as a traveller (hereinafter referred to as “Traveller/s”) and any accommodations establishment (hereinafter referred to as “Establishment/s”)who is registered with Travel Moola as members, these Terms and Conditions represent the only terms on which Travel Moola trades and transacts.
1.2 The objective is to link Travellers and Establishment and allow Travellers to use their TravelMoola currency for accommodation at Establishments registered with Travel Moola. It is to allow Establishments to target a new niche market and increase their visibility, online marketing occupancy and turnover.
- How to “earn” TravelMoola currency
Travellers will earn TravelMoola currency on:
2.1 Registration as a member – 30 points
2.2 Fulfilling an order – hosting as an Establishment – 1- 5 points
2.3 Recruiting a traveller – 1 point
2.4 Recruiting an Establishment – 2 points
2.5 Selling a digital product, service or course – points vary to relate to dollar value;
2.6 Surprise loyalty points issued by Travel Moola; and /or
2.7 Bonus points for outstanding buyer / referral behaviour.
- Establishments
3.1 Establishments have to accept all bookings on the Travel Moola site, for a maximum of 3 nights, subject to Travel Moola points, availability, and with the exception of the chosen high season dates specified by the Establishment.
- Establishments have to accept the Travellers booking:
3.2.1 Any time, including weekends; and /or
- For a stay of 1 – 3 nights.
3.2.3 Extended stay is to be negotiated either at standard rates, discounted rates or using Travel Moola currency.
- Establishments may decline a Traveller’s booking only for the following reasons:
3.3.1 Lack of availability (Travellers can check this on the TravelMoola site before sending an enquiry);
- During the Establishment’s high season, which is a maximum of 40 days per year, this will include peak seasons and event dates subject to the discretion of the Establishment. These dates are indicated on the TravelMoola site by the Establishment;
3.3.3 These high seasons will vary from Establishment to Establishment and vary per area, e.g., Clarens area has a Beer Fest end of February and this may be considered high season for Clarens and surrounds; and July is high season in Clarens and Lesotho, but low season in the Cape;
3.3.4 This clause 3.3 allows Establishments to still charge top rates during high season. With planning the traveller can still use their TravelMoola every night.
3.4 Each Establishment has their own terms of service which still apply. Details of this will be on the Travel Moola site by the Establishments, e.g., No children, No pets, Minimum stays, Minimum of 2 persons per unit/room, etc.
- Additional services offered by Establishments are to be paid directly to the Establishments. TravelMoola currency is not valid for extra services, e.g., Meals, Spa services, Excursions, etc. This enables the Establishment to make upsells for increased income.
- Cancelation Policy
- If, a Traveller cancels less than 1 week before arrival, the TravelMoola currency will still be deducted from the Traveller’s account and credited to the Establishment automatically.
4.2 If, a Traveller cancels with more than 7 days’ notice, the Traveller will be refunded all TravelMoola. Travel Moola requests that Travellers give as much notice as possible, cancel sooner rather than later, it is the kind thing to do.
4.3 A “no show” will still be credited to the Establishment and the Traveller may receive a negative review.
- The Establishment may not cancel the booking. In the event of an emergency a request will need to be sent to the help desk of Travel Moola explaining the situation. Travel Moola management will make the final call. The Establishment may receive a negative review.
- Reviews
5.1 Reviews are like old school word of mouth, when a person is friendly and kind, others are friendly and kind. Travel Moola wants our community to build friendships and kindness.
5.2 When you meet an awesome person, or have an amazing experience or stay in a special place, it is natural to tell everyone about it. In our digital world we do this via online reviews.
5.3 Reviews are vital part of making our community a wonderful place.
5.4 Reviews are there to provide Travellers and Establishments peace of mind when making and accepting bookings.
5.5 Travellers review an Establishment with an honest video review and star rating. Travellers are required to upload, unedited video reviews on the Travel Moola site. These are more authentic and help promote the Establishment even more. The video needs to show the room that the Traveller occupied and other “cool parts” of the venue (Establishment).
5.6 Establishments also review the Traveller and provide a star rating. Travellers also need to be kind and considerate to fellow travellers, Establishments, owners and staff.
5.7 The reviews of Travellers and Establishments appear on the Travel Moola site.
5.8 Travellers will review Establishments on the following criteria:
5.8.1 Host / check in process;
5.8.2 The vibe
5.8.3 Hospitality;
5.8.4 Cleanliness;
5.8.5 Accuracy of Listing; and
5.8.6 Accuracy of badges.
5.9 Travellers will select the respective star ratings in respect of the above-mentioned criteria.
- Establishments will review Travellers on the following criteria:
5.10.1 Neatness;
5.10.2 Kindness;
5.10.3 Communication skills;
5.10.4 Respect of house rules
5.10.5 Accuracy of profile/listing; and
5.10.6 Accuracy of badges.
5.11 Establishments will select the respective star ratings in respect of the above-mentioned criteria.
5.12 Reviews must be honest, positive or negative. But no bulling, discrimination, slander or personal attacks will be tolerated.
5.13 We advise that negative experiences be bought to the attention of the other party during the stay. This allows both parties to amend any problems. A negative review and complaints after leaving the Establishment are counterproductive. The purpose is for Travellers and Establishments to help each other to grow their business endeavours constructively.
5.14 Twice a year Travel Moola reviews all Travellers and Establishments and will award SuperStar status to outstanding Travellers and Establishments. These Travellers and Establishments will receive a verified badge, which is displayed on their profile.
5.15 Travellers and Establishments with 3 seriously negative reviews will be removed from Travel Moola (the community, platform and site).
- Social Sharing
6.1 Leveraging social media is the best and most cost effective way for Establishments to grow their businesses. The aforesaid is valid for digital entrepreneurs and institutions.
6.2 Many accommodation places do not have a strong social presence. Some do not have the skills or desire to promote their business effectively on socials.
6.3 Travel Moola creates the platform where the Travellers say thank you to the Establishment for their free stay. Travel Moola Travellers are tech savvy and have social media accounts.
6.4 Travellers are required to post their video review on the Establishment on the Travel Moola site AND share it on their social platforms, with the option of tagging the Establishment. The reach of this is potentially enormous and is hugely beneficial to the Establishment. The Travel Moola site (system) will track this, and Travellers cannot make another booking until video reviews have been posted correctly.
- Dash Board
7.1 Travellers and Establishments will have a secure log in (Travel Moola site), where they can access their personal dashboard.
7.2 Here (personal dashboard) the following information and actions will be available:
7.2.1 TravelMoola currency: Debits, credits and balances;
7.2.2 Previous and pending bookings;
7.2.3 Access to secure chat between Travellers and Establishments.
7.2.4 Secure chat with the Travel Moola help desk;
7.2.5 Editing or updating profiles and listings; and
7.2.6 Travellers and Establishments may add deals, promote events, utilize additional sales pages, featured and promoted ads to increase visibility and make direct sales.
- Badges and Awards
8.1 Travel Moola has a very unique way of linking Travellers and Establishments. Badges give a quick visual form of identification and offerings. Rankings reward fabulous Travellers and Establishments.
- Travellers and Establishments select their own badges. Travel Moola does not monitor this. It is up to the reviews to verify accuracy of selected badges, e.g., pet friendly. The aforesaid are unverified badges.
8.3 Verified badges are awarded by Travel Moola, when a Traveller or Establishment achieves or meets certain criteria, e.g., SuperStar Guest / Host, unique stay, luxury lodge ect.
- TravelMoola Validity
9.1 TravelMoola currency is valid and available as long as you remain a member (registered with Travel Moola).
9.2 TravelMoola currency does not expire. Balances will be carried over from year to year.
9.3 Your membership will automatically renew each year, the annual fee to be deducted from
your credit card
9.4 You can cancel your membership (subscription) at any time. No prorate refunds will be made.
9.5 To prevent the Travel Moola annual fee being deducted on your renewal date, you will need to inform Travel Moola at least 14 days prior to the renewal date. Travel Moola will remind you when your membership is about to expire.
9.6 If you have more TravelMoola than you can spend on accommodation, you can use your TravelMoola to purchase products, services and online courses in the shop section (Travel Moola site).
9.7 On resignation of your membership, any TravelMoola currency will be forfeited.
9.8 TravelMoola currency is non-transferable.
9.9 TravelMoola currency has zero currency (rand/dollar) value outside of the TravelMoola platform.
- Miscellaneous
10.1 No provision of these Terms and Conditions may be amended, substituted or otherwise varied, if Travel Moola has not agreed in writing thereto.
10.2 These Terms and Conditions constitutes the entire Terms and Conditions between Travel Moola, Travellers and Establishments in connection with the subject matter and supersedes all prior representations, communications, negotiations and understandings concerning the subject matter of the Terms and Conditions.
10.3 These Terms and Conditions shall be interpreted in accordance with and governed in all respects by, the laws of the Republic of South Africa.
10.4 Travel Moola makes no warranty, expressed or implied, regarding the fitness, merchantability, design, condition, capacity, concept, performance or any other aspect of the above Travel Moola transactions.
10.5 Travellers and Establishments shall have no claim against Travel Moola in respect of any damages, losses, expenses, injuries, etc., resulting from the above Travel Moola transactions. Travellers and Establishments hereby indemnifies and holds TravelMoola harmless for any damages, losses, expenses and/or injuries that may arise, directly or indirectly, from the above TravelMoola transactions.
10.6 Travellers and Establishments acknowledge that, Travel Moola has a very unique original commercial endeavour, patent, idea, trade, product and /or arrangements as per the above Travel Moola transactions (hereinafter referred to as “Travel Moola’s Interests”).
10.7 The Travel Moola’s Interests shall at all times be and remain, the sole and exclusive property rights of Travel Moola. Travellers and Establishments shall have no right, title or interest to the Travel Moola’s Interests, except as expressly set forth in these Terms and Conditions. Hence, Travellers and Establishments shall not, either alone or jointly, together with any other person or entities, be interested or engaged in any capacity whatsoever, in activities and / or transactions similar to Travel Moola’s Interests.
10.8 Travellers and Establishments shall not cede, assign or transfer their interests, rights and / or obligations in Travel Moola without the prior written consent of Travel Moola. The Travellers and Establishments shall keep their interests, rights and / or obligations in Travel Moola free and clear of all levies, taxes, duties, liens, charges and other encumbrances.
10.9 Nothing in these Terms and Conditions and / or the above Travel Moola transactions shall constitute or be deemed to constitute a partnership or joint venture or constitute an agency agreement between Travel Moola, Travellers and / or Establishments.
10.10 The signatory warrants that he / she is authorised to accept these Terms and Conditions.
